Ivanhoe Waverly Hundred HOA Meeting February 24, 2010
Ellis Traub, a retired Eastern Airlines pilot, who is facing District 4 Councilman Marlon Luis
in the race March 10th for councilman, introduced himself at our meeting and told us about himself.
Meeting was called to order at 7:40 pm by Val O'Connor, seconded by Tina Franetic.
Board of Directors in attendance: Tina Franetic, Val O'Connor, John Ayala, Levi Tyler
and Frank Milone.
12 people in attendance.
Representatives from Sherwin Williams came to our meeting to speak about paint suggestions,
showed us examples of colors for house paint and trim and discussed the book they are going to
make us to help homeowners with suggestions for colors to paint their houses with.
Treasury Report - Val O'Connor
Bank Balance as of Feb. 24th is $84,082.89
checks written for Jan. and Feb. are $6,506.34
So far 190 assessment checks have come in.
Facility Maintenance - Val O'Connor
The signs at the entrances were replaced with multiple paneled ones which enables
different messages to be used for different occasions.
The grate on Stirling Rd. by the canal was replaced by the city and they also replaced
the street signs and stop sign.
The landscaper said that the plants at the different entrances would be installed next week,
just waiting for the cold weather to subside.
Violations- Exclusive Property Management stated that it is not in their contract to attend our meetings,
only by request will they come. They will send us a report every month a few days before
our monthly meetings so we can review them.
Architecture-Frank
A roof was approved. It was stated that approval has not been necessary for choice of
color for house paint.

New Business
We discussed whether the wording of the proxies that were mailed out was legal to be
written that way. The discussion went on to what really matters is that we need to discuss
the changes we want to see made on the covenants. Some of the suggestions were:
1) Paint colors, to be only in the pastel range, which is 70% white and 30% color.
2) Take out wood shingles from Section 3, Architectural and Construction Restrictions
3.05 Homes B. of the Declarations of Covenants
Single-family dwellings shall not exceed thirty five (35) feet in height and shall have
roofs made of cement tile, vitreous clay, or wood shingles, except that dwellings
may have "built-up" roofs which overhang patio areas not visible from the street.
3) Prolong the 25 years of expiration of the homeowners' association term to a longer
amount of time in Section 11, Duration and Amendments.
11.01 Duration. The covenants and restrictions of this Declaration shall run with
and bind each Lot and shall inure to the benefit of, and be enforceable by the
Association or any Lot Owner, their respective legal representatives, heirs,
successors and assigns for a term of twenty-five (25) years from the date of this
Declaration. Thereafter this Declaration shall automatically be extended for
successive periods of ten (10) years unless an instrument is placed of record
containing certified resolutions of the Association certifying that two-thirds (2/3)
of the members of the Association have voted to terminate this Declaration.
Invalidation of any part of the restrictions herein contained shall not invalidate
the remaining restrictions which shall remain in full force and effect.
4) It was questioned whether a smaller percent of members would be more efficient than
66-2/3% of the homeowners for a quorum to vote for changes.
It was brought up to do all the changes at the same time. It was suggested that the only
legal way to get this voted upon was to go door to door and get signatures. It was also
suggested to go to the attorney with this after July 1st.
The issue on the sound wall was brought up and a statement came back from the Broward
County Commission District 5 saying that the I-75 corridor project is not funded and is not
going to be proceeded the foreseeable future.
A vote was taken to not allow an extra week before late letters were sent certified to the
homeowners who haven't sent in their assessment fees yet since they have had the same time
as everyone else to get them in.
