BOARD OF DIRECTORS MEETING

MINUTES

Pursuant to call upon proper notice, the meeting of the Board of Directors was held on July 27, 2011. 

PRESENT: Tina Franetic – President;  John Ayala – Director;  Kathie Carlisle – Secretary  

ABSENT:  Mike Haspsas – Director                                                                       

ALSO PRESENT:      

Lori Blitz- Exclusive Property Management;  Jay Mangel- Exclusive Property Management;  Ryan M. Aboud, Esq. – Backer Law Firm, P.A.                           

CALL TO ORDER:          

Tina Franetic, President called the meeting to order at 7:36 PM having established a quorum. 

FINANCIAL REVIEW: 

Discussion was held regarding the eighteen (18) delinquent homeowners. Six (6) residents are delinquent for 2010 and 2011 and twelve are delinquent for 2011.  

A MOTION was made by Tina Franetic to turn over all delinquent accounts to Backer Law Firm with a 2nd by John Ayala and APPROVED by Kathie Carlisle.  

Ryan Aboud from Backer Law Firm discussed that fact that late fees are not referenced in the Documents and the need for a Delinquency Action Plan. The Board would like to include a late fee on the 2012 coupons. 

Discussion was held regarding outstanding violations and enforcement throughout the community. It was explained that a Board approved violation procedure will be put into place to provide better enforcement.  

A MOTION was made by Tina Franetic to send all violation notices certified mail. The 1st violation notice should be sent certified with 10 days to cure and the 2nd violation should be sent certified with 10 days to cure before sending to the attorney. 2nd by John Ayala and APPROVED by Kathie Carlisle. 

The Board would like to review the violation letter templates and continue to work together to finalize the violation procedure. 

Residents were concerned about a trailer violation on Chillingsworth Lane, Private Property/No Trespassing signage placed in a cul-de-sac, parking issues, commercial vehicles and landscaping violations. 

A MOTION was made by Tina Franetic for Ryan Aboud to check the Documents for the availability to lien for unresolved maintenance items and recommend a Delinquency Action Plan. Mr. Aboud advised that it should not take more than one hour.  2nd by Kathie Carlisle and APPROVED by John Ayala.  

The Property Manager should contact the Town of Davie regarding the landscaping by the park and the center of the canal.  The landscaping company should be contacted regarding the common area landscaping. 

ADJOURNMENT:   

A Motion to adjourn was made  by Tina Franetic with a 2nd by Kathie Carlisle and approved by John Ayala at 8:42PM.
